Debt Settlement LawsPosted on May 24, 2010. Debt Settlement? What if a creditor refuses the settlement offer of corporate debt in respect of credit cards about my debt? Will I face legal action? They may drag you to court. It depends on how long you've been to. This also happened to me. My credit counselor could not reach an agreement with the CC company and I started to receive citations go to court. I had a lot (after going to court 4x a year), so I went bankrupt and, possibly, the citation has stopped coming. What I would do 1st is to cancel your credit counselor if it does not work and call the CC companies on your own to develop a payment plan. If they do not work with you I do declare bankruptcy because they will not go away. I had my check garnished it is not fun. People may think of your deposit for a bastard, but who cares about them it does not affect them. You have to what suits you best. Good Luck They can file a trial, but they can if they can not validate the debt. Ask them to validate the debt and get everything in writing The creditor should retain the same rights it had before. The creditor does not have to accept a settlement offer. They still have the right to continue collecting the debt, even if it means a lawsuit.
